Terms of Service

These Terms of Service ("Terms") govern your use of the MoJu AI interview preparation and authorized assistance platform (the "Service") provided by MoJu AI ("MoJu," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

These Terms constitute the entire agreement between you and MoJu with respect to the Service and supersede all prior or contemporaneous agreements, representations, warranties, and understandings, whether written or oral, relating to the Service.

1. Definitions

For the purposes of these Terms:

  • "Service" means the MoJu AI platform, including all web applications, desktop applications, browser extensions, mobile applications, APIs, dashboards, and any related tools or features provided by MoJu.
  • "User," "you," "your" means any individual or entity that accesses or uses the Service.
  • "Account" means your registered user account on the Service.
  • "Content" means any text, data, information, files, resumes, job descriptions, audio, video, or other materials that you submit, upload, or transmit through the Service.
  • "AI Output" means any response, suggestion, recommendation, analysis, transcription, or other content generated by the Service's artificial intelligence models.
  • "Credits" means the prepaid usage units in your MoJu wallet, where 1 credit equals 1 minute of Service usage.
  • "Interview" means any live or recorded interview, meeting, call, assessment, or examination conducted through or assisted by the Service.
  • "Overlay" means the real-time visual interface displayed on the User's screen during a live interview session.

2. Acceptance of Terms

By creating an account, purchasing credits, accessing, browsing, or using any feature of the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

If you are using the Service on behalf of an organization, company, or other legal entity ("Entity"), you represent and warrant that you have the authority to bind that Entity to these Terms. If you do not have such authority, you are personally liable for these Terms.

You acknowledge that these Terms may be updated from time to time, and that your continued use of the Service following any changes constitutes acceptance of the updated Terms.

3. Eligibility

You must be at least 18 years of age, or the age of majority in your jurisdiction, whichever is greater, to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding agreement.

The Service is intended for use by individuals who are preparing for or participating in professional interviews, meetings, or assessments. The Service is not intended for minors, and we do not knowingly collect personal information from anyone under 18 years of age.

If you are located in a jurisdiction that restricts or prohibits the use of AI-assisted tools in interviews, assessments, or examinations, you may not use the Service in connection with such activities. It is your sole responsibility to determine whether your use of the Service is lawful in your jurisdiction.

4. Account Registration and Security

You agree to provide accurate, current, and complete information during the registration process and to keep your account information up to date at all times. You represent that all information you provide is truthful and not misleading.

You are solely responsible for:

  • Maintaining the confidentiality and security of your Account credentials, including your password and any API keys or session tokens.
  • All activity that occurs under your Account, whether or not authorized by you.
  • Immediately notifying MoJu at admin@moju-ai.com if you become aware of any unauthorized use of your Account or any other breach of security.

MoJu reserves the right to suspend or terminate your Account if any information provided during registration proves to be inaccurate, incomplete, or misleading, or if MoJu reasonably believes that your Account has been compromised or is being used in violation of these Terms.

You may not share your Account credentials with any third party, nor may you allow multiple individuals to access the Service through a single Account unless such use is expressly authorized by MoJu in writing.

5. Service Description

MoJu provides an AI-powered platform with two distinct modes of operation:

Mode 1 — Interview Preparation & Coaching: Mock interviews, resume optimization, practice questions, and performance analytics. This mode is designed for offline practice and skill development. AI Output in this mode is generated based on your submitted materials and is intended solely for educational and preparatory purposes.

Mode 2 — Authorized Live Assistance: Real-time AI-generated answer suggestions during live interviews, meetings, or calls. This mode is provided for use only where you have obtained all necessary consents from all parties, where such use is permitted by applicable law and platform policies, and where the use does not violate any professional or academic integrity standards.

The Service may include, but is not limited to, the following features:

  • Real-time audio transcription and analysis
  • AI-generated response suggestions and recommendations
  • Interview performance scoring and feedback
  • Resume and cover letter optimization
  • Practice interview simulation with AI coaching
  • Session recording and playback
  • Cross-platform compatibility support

MoJu reserves the right to modify, suspend, or discontinue any feature of the Service at any time, with or without notice, without liability to you.

6. Payment and Billing

The Service uses a prepaid credit wallet system. Credits are purchased in packs via Razorpay, our third-party payment processor. By purchasing credits, you agree to Razorpay's terms of service and privacy policy in addition to these Terms.

Pricing: 1 credit equals 1 minute of Service usage. Credit packs are priced as displayed at the time of purchase. MoJu reserves the right to change pricing at any time, though changes will not affect credits already purchased.

Credit Expiration: Credits never expire and remain in your wallet until used or your Account is terminated.

Trial Credits: New users receive 15 minutes of free trial time, no credit card required. Trial credits are provided for evaluation purposes only and may be modified or withdrawn at MoJu's discretion.

Live Session Billing: During a live interview session, credits are deducted in real-time at the rate of 1 credit per minute. If your credit balance reaches zero during an active session, the session may be terminated without notice.

Refunds: All credit purchases are final and non-refundable, subject only to the limited exceptions described in our Refund Policy.

Taxes: You are responsible for all applicable taxes, duties, or levies imposed by any governmental authority in connection with your use of the Service, except for taxes based on MoJu's net income.

Chargebacks: If you initiate a chargeback or payment dispute for a legitimate purchase, MoJu may suspend your Account and all associated credits pending resolution of the dispute. MoJu reserves the right to pursue collection for fraudulent chargebacks.

7. Intellectual Property

The Service, including its design, code, algorithms, user interface, graphics, logos, trademarks, trade names, documentation, and all related intellectual property, is the exclusive property of MoJu and is protected by applicable copyright, trademark, patent, trade secret, and other intellectual property laws.

Subject to your compliance with these Terms, MoJu grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service solely for your personal, non-commercial purposes. This license does not include any right to:

  • Copy, modify, distribute, sell, or lease any part of the Service
  • Reverse engineer, decompile, or disassemble any aspect of the Service
  • Remove, alter, or obscure any proprietary notices or labels
  • Use the Service for any commercial purpose without written authorization from MoJu

Your Content: You retain ownership of all Content you submit to the Service. By submitting Content, you grant MoJu a limited, non-exclusive, royalty-free license to process, store, and transmit your Content solely for the purpose of providing the Service to you. This license terminates when you delete your Content or terminate your Account, subject to our data retention policies described in the Privacy Policy.

AI Output: You acknowledge that AI Output is generated by machine learning models and may not be unique. MoJu makes no claim of ownership over AI, and you are free to use AI Output as you see fit, subject to these Terms and applicable law.

8. Acceptable Use

You agree to use the Service ethically, responsibly, and in compliance with all applicable local, state, national, and international laws, regulations, and ordinances. You are solely responsible for ensuring that your use of the Service complies with the policies of any interview, exam, platform, or organisation you use it with.

By using the Service, you further agree that:

  • You will not use the Service in any manner that could damage, disable, overburden, or impair the Service or interfere with any other party's use of the Service.
  • You will not use automated systems, bots, scrapers, or other tools to access or interact with the Service unless expressly authorized by MoJu.
  • You will not attempt to circumvent any usage limits, credit systems, authentication mechanisms, or other technical restrictions of the Service.
  • You will not use the Service to transmit any viruses, malware, worms, trojans, or other malicious code.
  • You will not impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity.
  • You will not use the Service for any unlawful purpose or in furtherance of any illegal activity.

9. Prohibited Uses

You must NOT use the Service for any of the following purposes:

  • Cheating and fraud: Using the Service to cheat on interviews, exams, assessments, certifications, or any other evaluation where such use is prohibited or where you have represented that you are completing the work independently.
  • Impersonation and deception: Impersonating another person or using the Service to misrepresent your identity, qualifications, or affiliation with any person or entity.
  • Unlawful recording: Recording, transcribing, or intercepting any conversation without obtaining all legally required consents from all parties involved, in compliance with all applicable wiretapping, eavesdropping, and recording laws.
  • Security circumvention: Interfering with, disrupting, or circumventing any security measures, access controls, authentication mechanisms, or technical restrictions of the Service or any third-party platform.
  • Unauthorized access: Attempting to gain unauthorized access to any part of the Service, other user accounts, or any related systems, networks, or databases.
  • Harmful content: Using the Service to generate, transmit, or distribute content that is fraudulent, misleading, defamatory, obscene, threatening, harassing, or otherwise harmful or objectionable.
  • Commercial exploitation: Reselling, sublicensing, redistributing, or commercially exploiting the Service or any AI Output without written authorization from MoJu.
  • Academic dishonesty: Using the Service to complete academic assignments, examinations, or assessments where such use violates the academic integrity policies of your educational institution.
  • Platform violations: Using the Service in a manner that violates the terms of service, community guidelines, or acceptable use policies of any third-party platform, including but not limited to video conferencing platforms (Zoom, Google Meet, Microsoft Teams), assessment platforms, or proctoring services.
  • Data harvesting: Using the Service to collect, aggregate, or harvest personal data, AI models, training data, or other proprietary information from the Service.

MoJu reserves the right, but is not obligated, to investigate and take appropriate action against anyone who, in MoJu's sole discretion, violates this section, including but not limited to removing offending content, suspending or terminating accounts, and reporting to law enforcement authorities.

10. User Responsibilities

You are solely responsible for:

  • Recording consent: Obtaining all necessary consents before recording or transcribing any conversation. Many jurisdictions require all-party consent for recording. Failure to obtain required consent may expose you to civil and criminal liability.
  • Legal compliance: Complying with all applicable wiretapping, recording, privacy, data protection, and electronic communications laws in your jurisdiction, including but not limited to the Federal Wiretap Act (18 U.S.C. § 2511), state recording consent laws, the EU General Data Protection Regulation (GDPR), and the California Consumer Privacy Act (CCPA).
  • Platform compliance: Ensuring your use of the Service does not violate the terms of service, community guidelines, or policies of any third-party platform or service you use in connection with the Service.
  • Professional conduct: Ensuring your use of the Service complies with all applicable professional standards, codes of conduct, and ethical guidelines in your field.
  • Consequences: All consequences arising from your use of the Service, including but not limited to account suspension, termination, legal action by third parties, disciplinary action by employers or educational institutions, and any civil or criminal liability.
  • AI Output verification: Evaluating the accuracy, completeness, and suitability of any AI-generated output before relying on it for any purpose. AI Output may contain errors, inaccuracies, or biases and should not be treated as professional advice.
  • Data security: Maintaining the security of your own devices, networks, and systems when using the Service, including ensuring that your operating system, browser, and security software are up to date.

11. AI Output Disclaimer

You acknowledge and agree that:

  • AI Output is generated by artificial intelligence models and may contain errors, inaccuracies, outdated information, or biases. MoJu does not warrant the accuracy, completeness, reliability, or suitability of any AI Output.
  • AI Output is provided for informational and educational purposes only and does not constitute professional advice of any kind, including but not limited to legal, financial, medical, or career advice.
  • You are solely responsible for evaluating and verifying all AI Output before relying on it for any purpose, including interviews, meetings, or other professional interactions.
  • AI Output may vary in quality and accuracy depending on the input provided, the complexity of the topic, and the specific AI model used.
  • MoJu does not guarantee that AI Output will be free from harmful, offensive, or inappropriate content, and you use AI Output at your own risk.
  • AI models are subject to limitations and may not always produce desired results. MoJu is not liable for any decisions made or actions taken based on AI Output.

12. Overlay Features and Non-Intrusive Design

The Service provides a real-time overlay interface during live interview sessions. You acknowledge and agree that:

  • The overlay is designed to be displayed on your personal device screen and is intended for use only where permitted by all parties and applicable law.
  • MoJu does not guarantee that the overlay will function correctly in all environments, on all devices, or with all third-party software. Overlay functionality may be affected by operating system updates, browser changes, security software, or other factors beyond MoJu's control.
  • MoJu does not warrant that the overlay will not be detected by third-party software, screen-sharing platforms, or monitoring tools. The overlay features are provided on a "best effort" basis.
  • You are solely responsible for ensuring that your use of the overlay complies with all applicable laws, regulations, platform terms of service, and professional standards.
  • MoJu disclaims all liability for any consequences arising from the use of overlay features, including but not limited to detection by third parties, disciplinary action, or legal proceedings.

13. Third-Party Services and Integrations

The Service may integrate with or provide access to third-party services, including but not limited to payment processors (Razorpay), authentication providers (Google OAuth), analytics services, and communication platforms. Your use of such third-party services is subject to their respective terms of service and privacy policies.

MoJu is not responsible for the availability, accuracy, privacy practices, or terms of service of any third-party service. MoJu does not endorse and is not liable for any third-party service or any loss or damage caused by your use of such service.

You agree to indemnify and hold MoJu harmless from any claims arising from your use of third-party services in connection with the Service.

14. Data Protection and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, store, and disclose your personal information. By using the Service, you consent to the collection and processing of your data as described in the Privacy Policy.

Where applicable, MoJu processes personal data in accordance with:

  • The EU General Data Protection Regulation (GDPR) for users in the European Economic Area, the United Kingdom, and Switzerland.
  • The California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA) for California residents.
  • The Digital Personal Data Protection Act, 2023 (DPDPA) for users in India.
  • Other applicable data protection laws and regulations in your jurisdiction.

15. Consent Logging and Audit Trail

To ensure legal compliance and maintain an audit trail, MoJu logs certain information when you accept these Terms, including but not limited to:

  • Your user ID and account email
  • Date and time of acceptance
  • Your IP address
  • Your browser user agent string
  • A hashed browser fingerprint (derived from browser characteristics, not personally identifying)
  • The specific consent acknowledgments you provided
  • The version of these Terms you accepted

16. "AS IS" / "Best Effort" Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

MoJu does not warrant that:

  • The Service will be error-free, uninterrupted, or secure.
  • AI Output will be accurate, complete, or suitable for any particular purpose.
  • The Service will meet your specific requirements or expectations.
  • Defects in the Service will be corrected within any particular timeframe.
  • The Service is free of viruses, malware, or other harmful components.
  • The Service will function correctly on all devices, browsers, or operating systems.
  • Overlay features will function in all environments or will not be detected by third-party software.

Any non-intrusive overlay features are provided on a best-effort basis and may not work in all environments. MoJu does not guarantee that the overlay will be undetectable by third-party software. You assume full responsibility for your use of the Service and any consequences arising therefrom.

No oral or written information, advice, or representation provided by MoJu, its employees, or its agents shall create any warranty not expressly stated in these Terms.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MOJU, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, data, or business opportunities
  • Damage to reputation or goodwill
  • Cost of substitute services or products
  • Personal injury or property damage
  • Any damages resulting from the use of or inability to use the Service
  • Any damages resulting from AI Output or reliance on AI Output
  • Any damages resulting from third-party actions, including detection of overlay usage
  • Any damages resulting from unauthorized access to or alteration of your data

MoJu's total aggregate liability to you for all claims arising from or relating to the Service shall not exceed the greater of (a) the amount you paid to MoJu in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) one hundred dollars ($100 USD) or its equivalent in local currency.

The limitations in this section apply even if MoJu has been advised of the possibility of such damages and regardless of the theory of liability (contract, tort, strict liability, or otherwise).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. In such jurisdictions, MoJu's liability shall be limited to the fullest extent permitted by law.

18. Indemnification

You agree to indemnify, defend, and hold harmless MoJu, its officers, directors, employees, partners, agents, suppliers, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees and court costs) arising from or relating to:

  • Your use of the Service or any AI Output
  • Your violation of these Terms
  • Your violation of any applicable law, regulation, or third-party rights
  • Any content you submit, upload, or transmit through the Service
  • Your violation of any recording, privacy, or wiretapping laws
  • Your violation of any platform terms of service (e.g., Zoom, Google Meet, Microsoft Teams)
  • Your use of overlay features in environments where such use is prohibited
  • Any dispute between you and a third party, including employers, educational institutions, or interview platforms
  • Your negligent or willful misconduct in connection with the Service

MoJu reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification by you, in which event you shall cooperate with MoJu in asserting any available defenses.

19. Termination

By MoJu: We may suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

  • Violation of these Terms or any applicable law
  • Conduct that we determine, in our sole discretion, is harmful to other users, MoJu, or third parties
  • Fraudulent, abusive, or otherwise illegal activity
  • Extended periods of inactivity
  • Requests by law enforcement or government agencies

By You: You may terminate your Account at any time by:

  • Going to your account settings and selecting "Delete Account"
  • Emailing admin@moju-ai.com with your termination request

Effect of Termination: Upon termination:

  • Your right to use the Service ceases immediately.
  • Any unused credits are forfeited and are non-refundable.
  • Your session history and personal data will be deleted within 30 days, subject to legal retention requirements.
  • Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to Sections 7, 11, 16, 17, 18, 20, and 21.

20. Governing Law and Dispute Resolution

Governing Law: These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply to these Terms.

Arbitration: Any dispute, controversy, or claim arising out of or relating to these Terms or the breach, termination, or invalidity thereof shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996, as amended. The seat of arbitration shall be Bengaluru, Karnataka, India. The arbitration shall be conducted in English by a sole arbitrator mutually agreed upon by the parties, or failing agreement, appointed in accordance with the Act.

Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against MoJu.

Injunctive Relief: Notwithstanding the foregoing, MoJu may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights or confidential information.

Small Claims: Either party may bring qualifying claims in small claims court.

21. Modifications to Terms

MoJu reserves the right to modify these Terms at any time. When we make material changes to these Terms, we will:

  • Post the updated Terms on this page with a revised "Last updated" date.
  • Notify registered users via email or in-app notification at least 7 days before the changes take effect.
  • Require re-acceptance of the updated Terms before continued use of the Service.

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service and may request termination of your Account.

22. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable, or if modification is not possible, it shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

23. Waiver

No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision. MoJu's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

24. Assignment

You may not assign, transfer, or delegate any of your rights or obligations under these Terms without MoJu's prior written consent. MoJu may freely assign, transfer, or delegate its rights and obligations under these Terms without restriction and without notice to you, including in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of its assets.

25. Force Majeure

MoJu shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond MoJu's reasonable control, including but not limited to natural disasters, pandemics, war, terrorism, government actions, power outages, internet disruptions, third-party service failures, or other force majeure events.

26. Export Controls

You agree to comply with all applicable export control laws and regulations. You represent and warrant that you are not located in any embargoed country or subject to any government restriction that would prohibit your use of the Service.

27. Entire Agreement

These Terms, together with the Privacy Policy, Refund Policy, and Cancellation Policy, constitute the entire agreement between you and MoJu regarding the Service and supersede all prior and contemporaneous agreements, proposals, and communications, whether written or oral, relating to the Service.
